When Can You Claim Compensation for Flight Delays in the UK?

European regulation EC261 has been incorporated into UK law, ensuring continuity of passenger rights. In the UK, you can make a flight delay claim based on the following criteria:

  • Origin of the flight. The flight must depart from an airport within the EU or the UK. For arriving flights, the operating airline must be based in the EU or the UK.

  • Extent of delay. If the delay is at least 3 hours, you may be entitled to compensation from the airline.

  • Cause of the delay. Responsibility for the flight delay must be attributable to the airline. If the delay is due to extraordinary circumstances – adverse weather conditions, security risks, political instability, etc. – the airline has no obligation to compensate passengers.

Is There a Time Limit to Claim Compensation for a Flight Delay in the UK?

If you're wondering when you can claim compensation for a delayed flight, you'll probably also want to know what the time limit is for doing so. This issue is governed by European regulation EC261 and UK national laws. Generally, the time limit for making a flight delay complaint in the UK is six years. However, it is advisable to file your complaint as soon as possible after the flight delay.

What to Do if Your Flight is Delayed

If you experience a flight delay, here's what you should do:

  • Hold onto your boarding pass and other travel documents.

  • Ask why the flight was delayed.

  • Request food, drinks, and if necessary, free transport and hotel accommodation.

  • Keep all receipts of any extra expenses you may have had, including necessary food, clothing, etc.

  • Be careful not to sign any waivers or accept vouchers that will require you to waive your right to compensation.
