The provisions of the European Union legislation EC 261/2004 entitle passengers who have suffered disruption on EU airlines to claim compensation of up to £520. Thanks to this law, airlines are obliged to provide passengers financial compensation for instances of flight delays lasting more than three hours and flight cancellations that are not due to extraordinary circumstances beyond the airline's control. Passengers are also eligible for compensation if they are denied boarding because the flight has been overbooked.
Here's an overview of the key elements concerning EU airline compensation:
EU airline compensation rights: Discover the benefits of EC 261/2004, allowing passengers on EU airlines to claim up to £520 for disruptions.
Comprehensive coverage: The regulation covers flight delays over three hours, cancellations, and denied boarding due to overbooking—ensuring a wide range of compensation scenarios.
Eligibility criteria: Understand conditions like departing from an EU airport or an EU-registered airline and distance-based compensation ranging from £220 to £520.
Timeframe and connection flights: Learn that claims must be for delays beyond three hours within the last three years, even for missed connection flights, offering a broader scope for compensation.

EU Flight Compensation Amounts for Flight Delays
The EU flight compensation amount varies based on the extent of the delay and the flight distance. More specifically, the European legislation EC261 establishes the following:
Flights up to 1500 km with at least a 3-hour delay: passengers are entitled to a compensation of 250 Euros.
Intra-EU flights over 1,500 km and all other flights between 1,500 and 3,500 km: in this case, if the delay is at least 3 hours, the compensation is 400 Euros.
Flights outside the EU over 3,500 km: if the delay is at least 4 hours, the compensation is 600 Euros.
For UK passengers travelling in and out of the UK, compensation will be paid in British pounds, as shown in the table below:
| Less than 3 hours | 3 – 4 hours | More than 4 hours | Never arrived | Distance |
|---|---|---|---|---|
| ❌ £ – | ✔️ £220 | ✔️ £220 | ✔️ £220 | All flights 1,500 km or less |
| ❌ £ – | ✔️ £350 | ✔️ £350 | ✔️ £350 | Internal EU flights over 1,500 km |
| ❌ £ – | ✔️ £350 | ✔️ £350 | ✔️ £350 | Non-internal EU flights between 1,500 km and 3,500 km |
| ❌ £ – | ✔️ £260 | ✔️ £520 | ✔️ £520 | Non-internal EU flights over 3,500 km |
EU Flight Compensation Amounts for Cancelled Flights
For cancelled flights as well, the compensation varies based on the flight distance:
Up to 1500 km: compensation of 250 Euros (£220).
Intra-EU flights over 1,500 km and all other flights between 1,500 and 3,500 km: compensation of 400 Euros (£350).
Flights outside the EU over 3,500 km: compensation of 600 Euros (£520).
In the case of cancelled flights, the entitlement and amount of compensation can also vary based on the notice period provided by the airline and any alternative flights (re-routing) offered to the passenger. For more details, you can read the page dedicated to compensation for cancelled flights.
What Conditions Are Applied to Compensation?
For the airline to be bound by the EC 261 regulation, the flight has to leave from an airport in the EU or the airline has to be registered in the EU.
The trip has to be delayed for more than three hours for the claim to be considered. The maximum compensation is 400 EUR (£350) for disrupted flights that were due to depart from and arrive in countries which were all within the European Union, even if the flight distance was more than 2,175 miles (3500 km). If a flight delay leads to a missed connection flight, then you are also eligible to claim disruption compensation from an EU airline.
If the flight delay or cancellation is due to extraordinary circumstances, passengers are not entitled to compensation. Extraordinary circumstances include events beyond the airline's control, such as medical emergencies, political instability, security risks, etc.
Claiming Compensation for Flight Delays and Cancellations
How do you know when to claim compensation for a delayed or cancelled flight? Though the law can be complicated, we're here to break it down for you:
Delayed flights: you may be able to claim compensation if your flight arrived 3 hours or more late.
Cancelled flights: you may be eligible for compensation if your flight was cancelled less than 14 days before it was due to depart.
Overbookings: you are owed compensation any time you are denied boarding through no fault of your own — so long as you didn't voluntarily give up your seat.
What to Do if Your Flight is Delayed or Cancelled
If you experience a flight delay or cancellation, here's what you should do:
Hold onto your boarding pass and other travel documents.
Ask why the flight was delayed or cancelled.
Request food, drinks, and if necessary, free transport and hotel accommodation.
If you had a cancelled flight, ask for an alternative flight or a refund.
Keep all receipts of any extra expenses you may have had, including necessary food, clothing, etc.
Be careful not to sign any waivers or accept vouchers that will require you to waive your right to compensation.
