What are my rights in the event of Air India overbooking?

If you’ve been denied boarding due to overbooking on an Air India flight that is covered by UK261 or EU Regulation EC 261/2004, you’re protected. 3. Financial compensation

4. Airport assistance

If you’re denied boarding or if you agree to take the next available flight, Air India must provide assistance while you wait at the airport.

Your right to UK261 compensation expires in 6 years under UK law. EC Regulation 261 does not set a specific time limit, which instead depends on the country where the legislation applies.

Furthermore, in the event of denied boarding, there are certain situations in which UK261 / EC 261 do not grant compensation. There are two main cases:

You're responsible for being denied boarding: if you arrive too late at the gate or don't have the required travel documents, you're not eligible for compensation.
