EC261 compensation, also known in the United Kingdom as UK261 compensation, refers to the European Union regulation EC 261/2004, which establishes the European regulatory framework regarding passenger rights in the event of delayed, cancelled, and overbooked flights. Post-Brexit, the UK has maintained regulations similar to EC261, also known as UK261. UK law therefore provides similar rights to those under European law, including compensation.


Who is Eligible for Flight Delay Compensation under EU Regulations?

The compensation provided for by the EC261 regulation can be recognized in these cases:

  • Flights operated by EU-based airlines.

  • Flights departed from an EU country.

In the UK context, the law therefore applies to flights departing from the UK. The right to UK261 compensation is also linked to the extent of the flight delay, which must be at least 3 hours.

The delay must not be due to extraordinary circumstances, such as extreme weather conditions, security risks, political instability, etc.

How Much Compensation Can Passengers Claim for EU Flight Delays in the UK?

How do you know when you should claim compensation for a delayed or cancelled flight? Though the law can be complicated, we're here to break it down for you:

Delayed flights: you may be able to claim compensation if your flight arrived 3 hours or more late.
